10. Wet Weather Policy
This Wet Weather Policy forms part of the Terms and Conditions for Laser Shoot Australia (www.lasershoot.com.au). It is designed to comply with the Australian Consumer Law (ACL), as administered in New South Wales, which provides consumer guarantees for services, including remedies such as refunds or rescheduling in cases of major failure (e.g., where a service cannot be safely provided due to circumstances like inclement weather). We prioritize the safety and enjoyment of all participants in our laser clay pigeon shooting events, which are primarily conducted outdoors and thus subject to weather conditions. This policy outlines our fair and transparent approach to handling inclement weather or unforeseen acts of God, while respecting your rights under the ACL.
10.1. Definition of Inclement Weather and Acts of God
- Inclement Weather: Includes, but is not limited to, heavy rain, thunderstorms, high winds, lightning, hail, or extreme temperatures that could pose risks to participants, staff, or equipment.
- Acts of God: Refers to uncontrollable natural events such as floods, earthquakes, bushfires, or other disasters beyond human control that impact the event location or safety.
10.2. Safety Assessment
- On the day of the scheduled event, our team will conduct a thorough safety assessment no later than 2 hours before the start time.
- If the activity cannot be safely undertaken due to inclement weather or an act of God (e.g., poor visibility, slippery surfaces, electrical storm risks, or site inaccessibility), the event will be cancelled.
- We reserve the right to make the final decision on safety, based on professional judgment, local weather forecasts, and guidelines from relevant authorities (e.g., Bureau of Meteorology). This ensures compliance with ACL, which guarantees that services must be provided with due care and skill.
10.3. Refund and Cancellation Process
- Full Refund: If the event is cancelled due to inclement weather or an act of God and cannot be safely rescheduled on the same day, you are entitled to a full refund under the ACL. The refund will be issued to the original payment method within 21 business days.
- Rescheduling Option: Where possible, we will offer to reschedule the event to a mutually agreeable alternative date at no additional cost, as a remedy under the ACL. If rescheduling is not feasible or if you prefer a refund (e.g., in cases of major failure), the full refund will apply.
- No Refund for Partial Events: If the event has already commenced and must be halted mid-way due to sudden weather changes, a partial refund or credit will be offered, proportional to the uncompleted portion of the activity, in line with ACL requirements for remedies in cases of failure.
- Customer-Initiated Cancellations: This policy does not cover cancellations initiated by customers due to anticipated weather; our standard booking terms apply in such cases (e.g., notice periods for refunds). Under the ACL, you are not automatically entitled to a refund if the service can still be provided safely.
- Customers will be notified via email, phone, or SMS as soon as a decision is made.

10.5. Exceptions and Limitations
- This policy applies only to events booked directly through www.lasershoot.com.au.
- In cases where the event can proceed safely (e.g., drizzle with no safety risks), no refunds or rescheduling will be offered, as the service can be provided following ACL guarantees.
- Laser Shoot Australia is not liable for any additional costs incurred by customers (e.g., travel or accommodation) due to weather-related cancellations, except where such losses are foreseeable and result from a breach of ACL consumer guarantees (e.g., negligence on our part).
